MADE-TO-MEASURE TERMS & CONDITIONS
These Terms & Conditions apply to all bespoke, made-to-order, and custom services provided by MIC Design Limited – VIVIENNE TAM (“we”, “us”, or “our”) to the client (“you” or “Client”).
1. Scope
Bespoke Services include the design, customization, and/or production of items based on the Client’s specifications as agreed in writing.
2. Orders
Orders are confirmed only upon our written acceptance and receipt of full payment. Any requested change after confirmation is subject to our approval and may result in additional charges and revised timelines.
3. Pricing and Payment
Prices are based on the agreed specifications. Full payment is required upon order confirmation and is non-refundable.
4. Production and Delivery
Any production or delivery date provided is an estimate only. We are not responsible for delay caused by events beyond our reasonable control, including material shortages, shipping delays, or force majeure events.
5. Changes and Cancellation
Due to the custom nature of Bespoke Services, orders cannot be cancelled once production has commenced. Any approved change after confirmation may lead to additional charges and/or revised delivery dates.
6. Client Responsibilities
The Client is responsible for providing complete and accurate measurements, specifications, and approvals in a timely manner. We are not responsible for any issue arising from inaccurate, incomplete, or delayed information provided by the Client.
7. Change in Measurements
We are not responsible for any fit issue resulting from any change in the Client’s body measurements after order confirmation and before delivery. Any alteration required as a result of such changes is subject to feasibility and may incur additional charges.
8. Fittings and Approval
Where fittings, samples, or prototypes are provided, the Client’s approval, whether written or verbal, constitutes acceptance of the design and fit. Any further alteration requested after approval may incur additional charges.
9. Delivery and Risk
Delivery dates are estimates only. Risk of loss or damage passes to the Client upon delivery or collection, and shipping and insurance costs are the Client’s responsibility unless otherwise agreed in writing.
10. Returns and Defects
All bespoke sales are final. Returns, exchanges, or refunds are not accepted except in the case of proven manufacturing defects notified to us within 7 days of receipt.
11. Liability
Our liability is limited to repair, replacement, or refund at our discretion, to the extent permitted by applicable law. We are not liable for indirect or consequential loss, and nothing in these Terms excludes liability that cannot lawfully be excluded or restricted under Hong Kong law.
12. Intellectual Property
All designs, sketches, patterns, concepts, and related materials remain the intellectual property of VIVIENNE TAM unless otherwise agreed in writing.
13. Governing Law
These Terms & Conditions are governed by and construed in accordance with the laws of Hong Kong SAR.
14. Entire Agreement
These Terms & Conditions constitute the entire agreement between the parties in relation to the Bespoke Services and supersede any prior discussions or understandings relating to the same subject matter.
